2020 HOME COCKTAIL COMPETITION FOR CHARITY
OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
THIS CONTEST AND ANY ADVERTISEMENT RELATING THERETO IS INTENDED FOR PARTICIPATION/RECEIPT ONLY IN STATES WHERE LEGALLY PERMITTED AND SHALL BE CONSTRUED ACCORDING TO, AND GOVERNED EXCLUSIVELY BY, CALIFORNIA STATE LAW. IF YOU DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS SET FORTH IN THESE OFFICIAL RULES YOU ARE NOT ELIGIBLE TO PARTICIPATE IN THIS CONTEST. VOID WHERE PROHIBITED BY LAW.
OVERVIEW
Bartender at Large (“BAL”) and The Institute for Better Drinking (“IFBD”) are teaming together to bring the HOME COCKTAIL COMPETITION FOR CHARITY. This competition, featuring Gosling Castle Partners (“Goslings”), is intended for bartenders to stay engaged & creative during the shutdown, while helping to raise money for a good cause. Submissions will be via Instagram in order to remain compliant with all recommended social distancing guidelines.
In addition to the prizes listed below, Goslings will match all prize money as well as donate $5 up to $5000 for every entry to The Institute for Better Drinking (“IFBD”), so they can further their mission to fund educational grants for underprivileged bar professionals.
Cocktails will be judged by a criterion of creativity, taste & presentation. Creativity will comprise 30% of your final score, with taste comprising 60% and presentation comprising 10%. BAL will be selecting 3 winners from the USA and 3 winners from Canada.
PRIZES
First Place: $500 (in the winner’s respective currency) + $500 to a charitable organization of their choice
Second Place: $250 (in the winner’s respective currency) + $250 to a charitable organization of their choice
Third Place: $100 (in the winner’s respective currency) + $100 to a charitable organization of their choice
Bonus Prize: $100 (in the winner’s respective currency) to the Entry with the most Likes by the end of the Contest.
Note: The charitable organization of the winners’ choice cannot be any political organization.
ENTRY INSTRUCTIONS AND REQUIREMENTS
The enter, submit an original cocktail recipe and photo that meets the requirements described below (together with all other elements of the relevant posting to Instagram, your “Entry”). Submissions will take place via Instagram. A photo of the drink must be posted along with the recipe below & the hashtag #BALContest. Entries must be received by April 26th at 11pm PST. There is a limit of one (1) entry per person. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the Instagram account used to enter will be deemed to be the registrant or entrant. All entries become the sole and exclusive property of BAL and will not be acknowledged or returned.
RECIPE REQUIREMENTS
The recipe must be based on Goslings Rum and include at least one of the following products as the dominant spirit: Goslings Black Seal, Goslings Gold Seal or Goslings 151 Proof.
Cocktails are limited to no more than six (6) ingredients (including dashes, drops, and anything that alters the flavor of the cocktail).
Garnish does not count as an ingredient.
Preparation and mixing instructions must be included with your recipe.
You should specify the glassware to be used for serving. For example, highball, old fashioned, Collins, martini cocktail glass, margarita, pilsner, punch cup, wine glass or champagne flute, etc.
No homemade ingredients that are not available for retail purchase will be allowed. (Examples: pineapple syrup and grenadine are good to go, but an apple-avocado-lavender syrup is not.)
Agreement to Terms and Conditions: By participating in this contest, you indicate your unconditional agreement to the Terms and Conditions of Entry below, the contest requirements, and any and all decisions, which are final and binding. You cannot win a prize unless you comply with all requirements set forth herein. Gosling Castle Partners, Bartender at Large, and The Institute for Better Drinking reserve the right to change these Terms and Conditions or the requirements at any time, without prior notice. Any changes will be posted. Moreover, by participating, you represent that you are complying with any policies your employer may have regarding participation in contests of this nature.
TERMS AND CONDITIONS OF ENTRY
No purchase is necessary to participate in the Contest
Sponsor: The Contest is offered by The Institute for Better Drinking (“Sponsor” and “Administrator”)
Eligibility:
All entrants must be professional working bartenders.
“Professional bartender” is defined as someone employed by a bar, restaurant or catering service of sorts sometime in the six months prior to the start of the Contest.
Entrants employed by a retailer (bar, restaurant or catering service of sorts) must not have ultimate purchase decision-making power
No retail license owners, officers or buyers (or their family members) may enter the Contest
To be eligible to win, you may be required to provide your first name, last name, email address, zip code, year of birth and create a password, and will be obligated to agree to these Official Rules.
Competitors must be at least 21 years of age.
Competitors must be legal residents of the United States (except residents of Utah) or Canada
Competitors may not be “employed by” or “in an ambassadorship role” of any other spirit supplier or brand at the time of the start of the regional competition in April 2020.
Employees of Gosling Castle Partners, The Institute of Better Drinking, their affiliates, liquor wholesale licensees, advertising/promotion agencies and their immediate family members and household members of each, and retail license holders are not eligible. This promotion is void wherever prohibited, restricted by law. In the event that the contest is challenged by any legal or regulatory authority, the Sponsor or Administrator reserves the right to discontinue or modify the contest or disqualify participants residing in the affected geographic areas. In such event, the Sponsor and Administrator shall have no liability to any entrants who are disqualified due to such an action. Contest void wherever prohibited or restricted by law.
Each Entry must meet all of the following requirements or it will be disqualified:
Entry must not contain illegal activity.
Entry must not portray Gosling’s or its products negatively.
Entry must be original and the sole property of submitter
Entry must not incorporate/prominently display any third-party brands or trademarks other than that of Gosling’s.
Entry must not violate any third-party rights, including copyright and right of publicity.
Entry must not contain material which is (or promote activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating or the mutilating of animals, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal, offensive, threatening, profane, or harassing, or otherwise unsuitable content as determined by Sponsor in its sole discretion.
Entry may not contain any materials or use that violates the Distilled Spirits Council Code of Responsible Practices.
Entry shall not contain images of persons less than 25 years of age or who appear to be less than 21 years of age.
Sponsor, in its sole direction, reserves the right to disqualify any Entry that does not meet these requirements.
By submitting an Entry, you warrant that:
You are the creator of the entry.
The entry is wholly original.
The entry does not infringe the intellectual property, privacy, publicity rights or any other legal or moral rights of any third party, including any current or former employer, and does not defame any person or identify any person by name or other identifying information.
The entry has not previously been entered in any other contest.
The entry has not been previously published in any medium (with exception of the classic cocktail).
The entry does not violate any law or regulation.
The Sponsor's determination as to whether any entry potentially violates the rights of any third party is final.
BY SUBMITTING THE PHOTO, THE ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE AND INTEREST NECESSARY TO GRANT THE SPONSOR THE WORLDWIDE, IRREVOCABLE AND UNRESTRICTED RIGHT AND LICENSE TO ADAPT, PUBLISH, USE, EDIT, AND/OR MODIFY SUCH PHOTO IN ANY WAY AND POST THE PHOTO ON THE INTERNET OR USE THE PHOTO IN ANY OTHER WAY AND AGREES TO INDEMNIFY AND HOLD SPONSOR HARMLESS FROM ANY CLAIMS TO THE CONTRARY. Entries must be in English. Entries must not allude to the overconsumption or irresponsible consumption of beverage alcohol. Entries that do not include all required information and do not adhere to the foregoing and following requirements will be considered void and not be considered in the judging of this contest. Entries that are deemed by the Sponsor in its sole discretion to be illegal, obscene, profane or not in keeping with the Sponsor's image will be disqualified.
Rights to Entries. By entering, you: (a) irrevocably grant Gosling Castle Partners, Bartender at Large, and The Institute for Better Drinking, and each of their agents, licensees, and assigns (collectively, the “Rights Holders”) the unconditional and perpetual (non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Entry as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude the Rights Holders’ use of your Entry, or require any further permission for the Rights Holders to use the Entry; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Rights Holders on the grounds that any use of the Entry, or any derivative works, infringes any of your rights as creator of the Entry, including, without limitation, copyrights, trademark rights, and moral rights.
Publicity. Except where prohibited, by participating in the Contest, you agree that the Rights Holders and any media attending events related to the Contest may use your name, likeness, voice, opinions, photographs, audio-visual footage, recipe, biographical information, state of residence, and/or any other record of your participation in the Contest for promotional purposes in any press releases, advertisements, television, radio, film, documentary, internet, or in any other publication or media without further payment or consideration. Each potential prize winner must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Each potential winner will be notified by email after the date of the selection. The potential winner may be required to sign and return to Sponsor, within five (5) business days of the date notice is sent, an affidavit of eligibility, and liability/publicity release in order to claim his/her prize if applicable. If the potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, or if the prize or prize notification is returned as undeliverable, the potential prize winner shall forfeit the prize. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner based on the criteria set forth above.
General Conditions. In the event that the operation, security, or administration of the Contest is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prizes according to the criteria set forth above from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Terms and Conditions, or acts in a disruptive or unsportsmanlike manner. Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. The Contest is subject to federal, state, and local laws and regulations and is void in Utah and where prohibited.
Release and Limitations of Liability. By participating in the Contest, you agree to release and hold harmless Sponsor, Goslings Castle Partners, and Bartender at Large, and each of their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of Entries; (f) injury or damage to persons or property; or (g) the taxation of any prize, for which the winner will be solely responsible. You further agree to indemnify, release, and hold the Released Parties harmless from any claims that their use of your Entry (as contemplated in these Rules) violates or infringes upon the rights of any third party. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. By accepting a prize, any winner (a) releases Gosling Castle Partners, Bartender at Large, and The Institute for Better Drinking, and their affiliated companies and licensed alcohol wholesalers and retailers from any and all liability claims, action or proceedings arising out of or for injuries or damages sustained while involved in any promotion activity or connection with the use of the prizes and (b) consents to the use by Gosling Castle Partners, Bartender at Large, and The Institute for Better Drinking for promotional purposes in connection with this promotion of their name and/or likeness and/or voice without further compensation where permitted.
The Sponsor and participating promotional companies are not in any way liable for damages, loss or injury resulting from computer malfunctions, misdirected or incomplete entries or acceptance and use of the prize. Gosling Castle Partners, Bartender at Large, and The Institute for Better Drinking reserve the right in its sole discretion to cancel or suspend this contest should viruses, bugs or other causes beyond the control of the Sponsor corrupt the administration, security or proper play of the contest. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel terminate or suspend the contest. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft, destruction or unauthorized access to, or alteration of, entries. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek damages from any such attempt.
Sponsor reserves the right to cancel, suspend and/or modify the contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Disputes. Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, without resorting to any court of law, or to any form of court case or action. In case no result can be achieved through mediation, all disputes, claims, and causes of action arising out of or in connection with the Contest shall be resolved individually and exclusively by the appropriate court located in California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.

Information collected from entrants is subject to the Sponsor’s Privacy Policy, a copy of which may be obtained by contacting the Sponsor by mail.
